PRICE

Our prices are listed by unit and include all taxes applicable to sales in the UK. Prices include packaging and delivery. We make every effort to maintain accurate prices on our site and under usual circumstances, only raise prices once a year, however the nature of the cheese business, the effect of any currency fluctuations and fuel costs mean that prices can change. We reserve the right to alter any prices or specifications at any time without notice. In case of any alteration, the price at the point of despatch will be charged, however we will make every attempt to notify you if this is different to the published price. You will be given the option of cancelling your order without penalty if the price is not acceptable.

QUOTATIONS

Any quotations given by the company are subject to the same possibility for fluctuation and change as our normal pricing (ref Pricing) and are made without engagement.

PRODUCT SUBSTITUTION

Farmhouse cheese is variable and sometimes the cheeses we’ve advertised may not be in stock or suitable to send. If that is the case we will substitute a similar cheese. We will always charge you the advertised price. If you would rather cancel your order than receive a substitution, you must, please, tell us when you place your order.

DEFECTIVE GOODS

We take great pride in the quality and condition of our cheeses. Please notify us within 24 hours of receipt if goods are out of condition or damaged during delivery. Our perishable goods can not be returned but compensation or replacement can be offered. Non perishable goods should be posted back to us and we will reimburse you for postage. If you have a problem we will make every effort to resolve it to your satisfaction. If you can email pictures of any severely damaged deliveries to us at mailorder@nealsyarddairy.co.uk, we would appreciate it. It helps greatly when following up with our courier company.

DELIVERY

Our delivery days are Tuesday, Wednesday and Thursday between approximately 8am and 6pm. Orders are dispatched to arrive on the day you specify wherever possible, provided we receive it at least 5 days in advance or in the case of holiday seasons, before an advertised cut off date. We deliver by overnight couriers for delivery to UK mainland addresses (excluding Highlands and Islands). At busy times of year this service can take 2 days. Please make sure the delivery address and postcode are correct (especially the latter) as we cannot be responsible for non-delivery due to a wrong address/postcode.

Please ensure someone is available to receive and sign for your purchase and put it in a cool place. It may be most convenient to send it to a work address.

In all cases, please use the field DELIVERY INSTRUCTIONS which you will see as you enter your order. These instruct the delivery driver to leave the parcel safely at its destination and can override the need for a signature when delivering to a private address. Examples of delivery instructions could be: ‘leave in the garage / with neighbour’ or ‘leave at reception’ (if delivery is to work). If you instruct for the parcel to be left without a signature, choose a cool and sheltered place which is not susceptible to theft. Parcels are left at your own risk and we cannot accept responsibility for the condition of the goods or non-receipt. However we will not process orders without some alternative delivery instructions.

Any delay in despatch and/or delivery for whatsoever reason shall not be grounds for a claim for consequential loss.

We work very hard to deliver the goods on the day agreed, however we reserve the right to deliver the goods up to 2 working days later in the event of circumstances beyond our control (for example: floods, snow, civil actions, delivery vehicle breakdown etc.). For essential orders allow at least 2 working days for delivery (up to 3 at busy times of the year like just before Christmas or Easter) and please do give us as much notice as possible.

PAYMENT

We must have received payment from you before an order can be processed. We accept payment on line by Maestro, Solo, Electron, Visa, MasterCard and Delta. Your payment is processed via a fully authorised Payment Service, which ensures that all your information remains totally confidential. In the event that any payment is subsequently dishonoured, any amount due will be chargeable with interest at the rate of 4% per annum over the base rate of LloydsTSB at the date on which payment falls due, even if we have in the past waived any such claims to interest and/or surcharges. We reserve the right to remove any discount that may have been allowed, without notice, if payment is not made in full by the due date. All costs including legal fees incurred in collection of amounts due or in enforcing under the Title clause below will be payable by you, the customer.

CANCELLATION OF ORDER

Neal’s Yard Dairy reserves the right not to accept or to cancel any order once accepted, without penalty. You may cancel an order without penalty only before we have processed it.

TITLE

All rights of ownership and to possession of the goods supplied shall remain in the name of and belong to Neal’s Yard Dairy until full payment has been received for the goods.

RISK

Risk of damage or deterioration to the goods supplied passes to you, the buyer, on delivery. No claim for damage or deterioration after delivery can be accepted.

CONTRACT TERMS

We shall supply goods only on the condition that these terms and conditions represent the entire agreement between ourselves and our customers and these conditions superseded any prior agreement or arrangement.

PRIVACY & YOUR INFORMATION

We retain details necessary for successful fulfilment of your order and may use them for marketing purposes for example emailing or posting you information about seasonal offers. These include: name, address, telephone number and email address of sender, name, address, telephone number and email address of recipient. We do not sell addresses to any other companies. We will never cold call you for marketing purposes. Credit card numbers are not retained after payment has been received.
